Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and Jarrah Labs Pty Ltd (ACN 698910888), an Australian company (“PuntWars”, “we”, “us”, “our”), and govern your use of the PuntWars mobile app and website (the “Service”).

By downloading or using PuntWars, you agree to these Terms and acknowledge that we collect, use, and disclose personal information as described in our Privacy Policy. If you don’t agree, don’t use the Service.

1. What PuntWars is

PuntWars is a free-to-play sports prediction game and simulation, built for entertainment and competition. Odds and results are drawn from real-world sport to make the simulation realistic, but all play uses virtual currency only.

2. No gambling and no real-world rewards

PuntWars is a game of entertainment and skill-based competition using virtual currency only. It is not gambling and does not offer wagering, betting accounts, bookmaker services, or financial products.

• You cannot deposit money to wager, and you cannot withdraw or cash out anything.
• PuntWars does not award cash, gift cards, merchandise, cryptocurrency, vouchers, discounts, prizes, or any other item of real-world value based on gameplay, betting performance, rankings, divisions, leagues, achievements, referrals, or any other in-game activity.
• All rewards consist solely of Virtual Items, rankings, status, and achievements that have no monetary value and exist only inside the game.
• All game outcomes are determined solely by real-world sporting results and game mechanics — never by purchasing activity.

Any resemblance to real-world betting exists only to simulate sports-prediction mechanics for a competitive entertainment experience. The in-game economy is closed by design — there is no way to turn in-game success into real-world value.

3. Eligibility — 18+

You must be 18 or older to use PuntWars. By using the Service you confirm you are 18 or older and able to enter into this agreement. We may ask you to confirm your age and may suspend or close accounts we reasonably believe belong to under-18s. PuntWars involves simulated betting mechanics, which are restricted to adults in many places, including Australia.

You’re responsible for complying with the laws that apply where you are. If access to games with simulated betting mechanics is restricted where you live, don’t use the Service. We may limit or withdraw availability in any location at any time.

4. Your account

To use most features you’ll create an account. You agree to provide accurate details, keep your login secure, accept responsibility for activity under your account, keep to one account per person, and not share or sell your account. You must not use bots, scripts, automation, or emulators to access the Service or to gain virtual currency, XP, achievements, or ranking. Tell us at support@puntwars.com if your account is compromised.

5. Licence

We grant you a limited, personal, non-transferable, revocable licence to use PuntWars for your own personal, non-commercial entertainment. We keep all rights not expressly granted.

6. Virtual currency and items

PuntWars uses virtual “Bankroll” and “Coins”, plus virtual items such as power-ups, levels, and achievements (“Virtual Items”). As set out in Section 2, Virtual Items have no monetary value and can’t be cashed out, transferred, sold, or moved between accounts. In addition:

• Virtual Items are licensed to you for use in the game only, not owned by you.
• Free Bankroll is capped and subject to in-app limits.
• We may adjust, re-balance, expire, remove, or reset Virtual Items and the in-game economy at any time to keep the game fair and working, without liability to you.

On closure of your account or the Service, Virtual Items are forfeited without compensation, except where a law that can’t be excluded says otherwise.

7. Purchases

PuntWars offers optional in-app purchases (e.g. Coins and Bankroll top-ups), processed by Apple or Google under their terms. We don’t receive or store your card details. Purchased Coins and Bankroll are entertainment features with no monetary value: purchases don’t increase your chance of receiving anything of real-world value, can’t be redeemed or cashed out, and never determine game outcomes — those depend only on real-world sporting results and game mechanics. Except where the law or the app store requires otherwise, purchases are final; refunds are handled by the relevant app store. Prices and item contents may change.

Australian consumers: Our services come with guarantees that can’t be excluded under the Australian Consumer Law. Nothing in these Terms excludes or limits those rights, and the rest of these Terms applies only so far as it’s consistent with them.

8. Competitions, divisions, and leagues

Divisions, leagues, and leaderboards award Virtual Items and ranking only (see Section 2). We set and may change the rules, scoring, settlement, and timing to keep things fair, and may correct results, reverse settlements, or void bets affected by error, bad data, abandoned fixtures, or manipulation.

League creators get tools to run their own competitions but must follow these Terms, and we’re not responsible for how they run them. League creators and participants must not collect, facilitate, advertise, or distribute money, prizes, gift cards, cryptocurrency, merchandise, or anything of real-world value in connection with a league, whether through the Service or off-platform. We may suspend or remove any league that appears to involve real-money gambling, prize pools, sweepstakes, raffles, or similar activity.

9. Sports data, names, and logos

Fixtures, results, and odds come from third parties and may be delayed or wrong. We don’t guarantee them and may settle, re-settle, or void in-game bets to match corrected real-world data. To the extent permitted by law, we’re not responsible for losses, rankings, settlements, or game outcomes resulting from delayed, inaccurate, incomplete, interrupted, or unavailable third-party data.

All team, club, and competition names and logos belong to their owners. PuntWars uses them only to identify the real teams and fixtures you’re predicting on. PuntWars is independent and is not affiliated with, sponsored by, or endorsed by any league, club, team, or organisation. We claim no rights in these marks. If you own a mark and have a concern, contact support@puntwars.com.

10. User content and conduct

You’re responsible for what you post (bets, comments, league names, usernames, profile info). You keep ownership but grant us a licence to host and display it to run the Service. Don’t post anything unlawful, infringing, abusive, deceptive, or that impersonates others. You must not use the Service to advertise, promote, facilitate, coordinate, or direct others to real-money gambling services, betting syndicates, tipster services, sweepstakes, lotteries, or similar activities. You must not falsely claim any official affiliation with, or endorsement by, a league, club, team, or organisation. Don’t cheat, exploit bugs or the economy, manipulate competitions or rankings, collude, harass other users, scrape or reverse-engineer the Service, or get around security or age controls. We may remove content, reverse in-game gains, and suspend or close accounts for breaches, but we’re not obliged to monitor content.

11. Our intellectual property

PuntWars — its software, design, branding, and content (other than your content and third-party data and marks) — belongs to us or our licensors. Except for the licence in Section 5, you get no rights in it and must not copy, modify, distribute, or sell any part of it without our permission.

12. Beta and experimental features

We may offer beta, trial, preview, or experimental features. These may be changed, suspended, or removed at any time and may not work correctly. They’re provided “as is” for you to try, and the disclaimers and liability limits in Section 15 apply to them.

13. Suspension and termination

We may suspend or close your access at any time if you breach these Terms, if we suspect cheating or manipulation, or if we need to for legal or app-store reasons or because we’re discontinuing the Service. You can stop using PuntWars and delete your account anytime in Settings. We may keep some information after deletion where the law requires it or for security, preventing cheating and abuse, dispute resolution, or enforcing these Terms, as described in the Privacy Policy. On termination your licence ends and Virtual Items are forfeited without compensation, except where a non-excludable law says otherwise. Sections 2, 6, 7, 9, 11, 15 and 16 survive.

14. Responsible play

PuntWars is for entertainment only and is not real-money gambling or practice for it. If play stops feeling fun, take a break. If you’re worried about gambling, free, confidential support is available in Australia at Gambling Help Online (1800 858 858 / gamblinghelponline.org.au), and local services exist in most other countries.

15. Disclaimers and liability

To the maximum extent permitted by law, the Service is provided “as is” and we don’t warrant it will be uninterrupted, secure, error-free, or that sporting data and results will be accurate or timely. You use it at your own risk. Because there’s no real-money wagering, you can’t lose real money by playing.

To the maximum extent permitted by law, we’re not liable for indirect or consequential loss, or loss of data, Virtual Items, or progress. For liability that can lawfully be limited, our total liability is capped at the amount you paid us in in-app purchases in the 12 months before the claim (which is nil if you’ve never made a purchase). Nothing here limits liability that can’t be excluded under the Australian Consumer Law or other law, including your consumer guarantees. You agree to cover losses we reasonably incur from your breach of these Terms or misuse of the Service, except to the extent we caused them.

16. Governing law

These Terms are governed by the laws of Western Australia, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. This doesn’t take away any mandatory consumer protections of your home country. Please contact support@puntwars.com first so we can try to sort out any problem informally.

17. Changes and general

We may update these Terms; we’ll update the date above and give reasonable notice of material changes in the app or by email. Continuing to use the Service means you accept the changes. If any part is unenforceable, the rest still applies. Our not enforcing a term isn’t a waiver. You can’t transfer these Terms; we may transfer them to a successor. Apple Inc., Google LLC, and their affiliates are not parties to these Terms and are not responsible for the Service, but are third-party beneficiaries entitled to enforce these Terms against you to the extent required by their platform terms. Your use is also subject to Apple’s and Google’s terms. These Terms and the Privacy Policy are the whole agreement between us about the Service.
